Survey Terms and Conditions

In General

1.1 Definitions. In general, terms commencing with a capital letter in these terms bear the meanings attributed to them in Article 1 of the general terms, or failing that, in these terms.
1.2 Relationship with General Terms. These terms, which apply to Surveys, are in addition to the general terms and other documents included in the Contractual Documentation. In case of any divergence between the general terms and these terms, the latter shall take precedence.

Subjects

2.1 Users can submit responses to questions, specifically by participating in Surveys (as defined in the general terms), to NOVA through the dedicated form(s) on the App, including in the form of push notifications.

2.2 Responses provided by registered Users participating in Surveys are anonymized and sold to NOVA’s Clients. For more information regarding the processing of data collected by NOVA, please refer to our privacy policy. It is reminded that by responding to a Survey, the User expressly consents to the use of their data (as described in the Contractual Documentation, particularly in these terms applicable to Surveys, and in our privacy policy).

2.3 The purpose of these terms applicable to Surveys is to govern the relationship between the User and NOVA during responses to Surveys.

2.4 The relationship between NOVA and its Clients is governed by separate agreements. The provisions of the Contractual Documentation applicable to Clients expressly refer to the Client.

2.5 For clarity, the use of NOVA’s Services does not create any contractual relationship between Users and Clients.

General Remarks

3.1 NOVA presents questions to registered Users on the Platform. Users may answer the questions within this context.
3.2 Generally, the User is not obliged to respond to questions and does so on a voluntary basis.

3.3 Only NOVA may formulate questions on the Platform. However, Clients may, through separate agreements, be authorized to request NOVA to ask certain questions formulated by the Clients or guide the selection of questions within topics determined by the Clients.

3.4 The User is bound and obligated to adhere to the Contractual Documentation, as well as to these terms applicable to Surveys.

Surveys – General

4.1 NOVA presents a predetermined number of questions per day to the User.

4.2 The User is free to respond or not to the Survey of the day.

4.3 The User is requested to answer questions and Surveys truthfully. The consequences of invalid responses are particularly indicated in Article 5.6 below.

4.4 The data collected during responses to Surveys are processed in accordance with our privacy policy.

 

Surveys – Remuneration Policy

5.1 In General. NOVA may discretely decide whether or not to compensate the User for responding to certain questions. The User acknowledges and expressly accepts that certain questions and Surveys do not entail any compensation.
5.2 Paid Surveys. Certain Users are eligible for compensation (the “Eligible User”) for all or part of the responses they provide to certain Surveys (the “Paid Surveys”). In such cases, the Eligible User is informed of their eligibility for said compensation (as described below). For clarity, Surveys for which no compensation is specified, or for which no information has been provided to the User in this regard, do not entitle the User to any compensation, regardless of whether they respond.

5.3 Remuneration Policy. In the case of Paid Surveys, the compensation for the Eligible User (the “Remuneration Policy”) generally consists of a fixed amount per answered question (the “Paid Questions”), which will be paid to the Eligible User (in accordance with Article 6 below). Generally, the compensation amount is indicated on the remuneration tab of the App.

5.4 Modification of the Remuneration Policy. NOVA reserves the right to revoke any entitlement to compensation or to modify its Remuneration Policy (both in principle and amount) at any time for all or part of the Users (Eligible or not). In the event of a modification to the Remuneration Policy, registered Users will be informed within a reasonable timeframe before the new Remuneration Policy takes effect, through a notification on the App and/or the Site, or any other means of NOVA’s choosing. Paid Surveys and Paid Questions to which a User (Eligible or not) has responded under the influence of a previous Remuneration Policy shall not be affected by the modification. By responding to a Survey, the User is deemed to have accepted the currently applicable Remuneration Policy.

5.5 Maximum Number of Paid Questions per day and Maximum Compensation. The maximum number of daily Paid Questions, and/or the maximum compensation amount for the Eligible User, is indicated on the App. NOVA reserves the right to withdraw the entitlement to compensation or to modify the maximum number of daily Paid Questions at any time, providing reasonable advance notice for Users who are already registered. In such an instance, NOVA will inform Users through the same method as provided in the case of a modification to the Remuneration Policy (Article 5.4 above).

5.6 NOVA does not pay any compensation to the Eligible User if the latter does not validly respond to the questions posed to them (e.g., systematically answering “yes,” or consistently checking the first proposed answer).

Surveys – Summary

6.1 In General. The User can access a general summary of the questions they have answered on the App in the calendar tab (the “Summary”).
6.2 Verification. The User is required to review the Summary on the first working day immediately following the end of each month (solely for the purposes of this article, the “Deadline”). They must inform NOVA, in writing or by email and within three days from the Deadline, if an error is observed in the Summary. After this period, or in the absence of a request for access to the Summary, the Summary, and respectively the Compensation indicated by NOVA, shall be considered accepted by the User and cannot be validly contested.

6.3 Means of Proof. The Summary and the data recorded by NOVA are presumed correct when determining the number of Paid Questions to which the User has responded. It is the User’s responsibility to demonstrate, in the event of a dispute, that the Summary and the data recorded by NOVA are incorrect.

Payment of User's Compensation

7.1 The compensation due to the Eligible User is calculated in accordance with the Remuneration Policy and based on the Summary (the “User’s Compensation”).
7.2 The User’s Compensation is typically paid by NOVA on a monthly basis. However, it is only paid if the Eligible User has responded to a minimum number of Paid Questions during the month (the “Minimum Compensation for Payment” threshold). This minimum number is subject to change and will be indicated in the App’s calendar tab.

7.3 NOVA pays the Eligible User’s Compensation within 30 days following the end of the month during which the Eligible User has answered Paid Questions, provided that the Summary is not contested in accordance with Article 6 above. If the accumulated Eligible User’s Compensation is less than the Minimum Compensation for Payment, NOVA will not make any payment of Compensation. It is further clarified that compensation does not accrue from month to month, so if the Minimum Compensation for Payment is not reached in a given month, no amount is carried over to the following month.

7.4 The Eligible User’s Compensation is paid to them in accordance with the banking information provided during their registration on the Platform. NOVA cannot be held responsible for incorrect information that delays or prevents the payment.

Liability

8.1 The User releases NOVA from any liability for any damages they may suffer due to their relationship with NOVA or NOVA’s Clients, except in cases of gross negligence or willful misconduct by NOVA. The User expressly waives any claims or demands for damages, including potential delays in the payment of the User’s Compensation and the use of their data in accordance with the privacy policy.

8.2 The general exclusion of liability of NOVA also applies to pre-contractual obligations and extra-contractual liability of NOVA.

8.3 In any case, NOVA’s liability cannot exceed the User’s Compensation.
