1.1 The purpose of this Privacy Policy is to inform Users about the nature of the personal data collected and processed by NOVA, as well as the purpose of such processing and the rights of Users in relation to the collected personal data.
1.2 This Privacy Policy applies in addition to the general terms and other documents included in the Contractual Documentation. In case of any discrepancies between the general terms and these conditions, the latter shall prevail.
1.3 If you disagree with this Privacy Policy, you are advised not to use the Site or the App and not to provide your personal data.
2.1 Automatically Collected Information. When accessing the Site or the App, certain data about the User is collected automatically (IP address, location, pages visited on the Platform, date and time of visit, User preferences, operating system, access data, etc.). NOVA does not use cookies. Similar processes to cookies are used on mobile devices. The data collected automatically in this context are processed in accordance with this privacy policy.
2.2 Information Provided Freely by Users. Users may be required to provide personal data to NOVA. The data necessary for registration on the Platform include the phone number, year of birth, and banking details (such as IBAN), the latter only for the purpose of User remuneration (where applicable). These data are mandatory, and their absence may render registration on the Platform impossible.
In addition to necessary data, optional data may be voluntarily provided by the User, for instance when responding to Surveys (as defined in the general terms). Necessary (mandatory) data are indicated in forms by the addition of an asterisk or by the inability to submit the form without completing the dedicated field.
2.3 Information About Minors. No data regarding Users under the age of 12 is collected. Data that might be inadvertently collected is promptly destroyed
4.1 User’s personal data (e.g., phone number or IBAN) is not transmitted to third parties for direct marketing purposes without the User’s explicit consent.
4.2 User’s personal data may be transmitted or communicated to third parties in Switzerland and/or abroad in the following cases: (i) to execute the contract between the User and NOVA (e.g., User remuneration where applicable). Data collected as part of Survey responses may also be used for the promotion of similar or identical articles that might interest the User, as well as to provide them with coupons or offers considered relevant; (ii) to execute the contract between NOVA and its Clients who have purchased Survey responses, statistical analyses, or the ability to ask questions and receive responses from Users; (iii) in the course of providing services on behalf of NOVA; (iv) when the User has consented to it; (v) in joint promotions or programs with partners; (vi) when required by law or when communication is reasonably necessary to enforce a court decision or respond to a legal claim; (vi) in case of merger, acquisition of the company, or business shares by another company.
4.3 NOVA anonymizes data collected as part of Survey responses for the purpose of transmitting them, for remuneration, to its Clients for research, statistical, or marketing purposes.
4.4 It is specified that the responses provided by the User in a survey are considered explicit consent (within the meaning of art. 5 para. 5 of the Federal Data Protection Act (DPA)) for the processing of data thus transmitted to NOVA.
4.5 NOVA does not have access to the User’s first name, last name, and email address, nor does it request them. The data transmitted to Clients are segmented data and are not linked to a specific User, but to population segments.
5.1 Right of Access. The User may request access to their personal data stored by NOVA at any time.
5.2 Right of Rectification. Users whose data is inaccurate or incomplete have the right to have it corrected. However, it is not possible to modify a validated response given in a Survey. The User may, however, request the deletion of the data (as mentioned in Article 5.4).
5.3 Right of Withdrawal and/or Opposition. The User may at any time object to the collection or processing of certain data about them (opting out). This objection may result in the cessation of Site use, App use, or the provision of Services.
5.4 Right to Deletion. The User has the right to request the erasure of personal data about them when its use is no longer necessary or when the User disagrees with the processing of their data. This data will be deleted as soon as possible, unless otherwise provided by law or if a legitimate interest of NOVA opposes it. It is specified that, in the absence of an express deletion request, the data transmitted by the User are retained (in accordance with Article 7) even in the event of deactivation of the User account.
5.5 Exercise of Rights. To exercise the above rights, the User can make a request at any time to the following address: info@nova-metrcis.com.
8.1 NOVA reserves the right to modify its Privacy Policy at any time. The modifications will be published on the Site and/or the App and will come into effect on the date of publication.
8.2 The currently online Privacy Policy is applicable. By continuing to navigate the Site and/or the App, the User accepts the current Privacy Policy.
